U.S. Export Regulations

Can I export my product?

The Commerce Department’s Bureau of Industry and Security (BIS) is responsible for implementing and enforcing the Export Administration Regulations (EAR), which regulate the export and re-export of most commercial items. Read more to Understand U.S. Export Controls and Dual Use Items and the China Dual-Use Export Regulation, Validated End User Requirement.

Can I export my product to a particular country or person?

In addition to reviewing BIS Denied Persons List and Unverified Lists, the Office of Foreign Assets Control ("OFAC") of the US Department of the Treasury administers and enforces economic and trade sanctions based on US foreign policy and national security goals against targeted foreign countries, terrorists, international narcotics traffickers, and those engaged in activities related to the proliferation of weapons of mass destruction. OFAC oversees the Specially Designated Nationals List.

How does the Foreign Corrupt Practices Act apply?

U.S. exporters must comply with the Department of Justice’s Foreign Corrupt Practices Act, which prohibits payments to foreign government officials for the purpose of influencing decisions in a manner that may favor the U.S. company’s commercial interests such as awarding contracts, issuing business licenses, issuing safety and quality certifications, customs valuation, or import license approval.
